Under Section 13 1a i.e desertion ground is it mandatory to file a petition for restitution of conjugal rights before that preceding year?

I have a query! Is Impotency not a ground for divorce under HMA? Whereas impotency is ground under section 12 (1) (a) Special Marriage Act. Can a hindu aggrieved who was married under HMA file a divorce petition under Special Marriage Act?
