How long is divorce before separation?
Most divorces proceed on the basis of a one-year separation. You can also get a divorce if there’s been adultery or cruelty, but in the vast majority of cases that we do, we do it on the basis of a one-year separation.
One of the issues is the date of separation? It’s the day when one person says to the other that, “Our marriage is over.” You don’t necessarily have to move out on that day for that to be the date of separation. You can be living together under one roof as a separated couple, and that time will count toward the one-year separation.
