The Veteran’s Pay was always intended to be protected from division and garnishment by Federal Law, US Title Code, stacks of case law, etc…it wasn’t until the improper decision of Rose V Rose that this ever came under questioning for greedy spouses to try to take what belonged wholly to the servicemember. Federal Law and Title Code was quickly changed, and family courts and unscrupulous lawyers still blindly and improperly cite Rose to this day. This is why the Veteran still wins on appeal, but has to pay through the teeth to have their rights and the law upheld.
The very premise of "protecting the former spouse" is pretty disgusting. It’s really just code for "how to steal."
A simple way to look at this is only the Retired pay for Longivity is seperate property. You will never see this on the RAS. This is caculated by DFAS. This is the true Retired Pay for longivity. Everything else is disabiity pay. This is usually a smaller amout if the Service Member has not done 20 years of Active Fedeal Service. Note: CRDP is in essence the replacement of retired pay. Remember that CRSC (combat-related special compensation) is compensation and therefore not taxable. The regulations governing CRSC prohibit division of CRSC by divorce actions. To figure out Retired pay for longivity you do this: Years of Service X 2.5% X the last High 3. For Example: 20 years service x 2.5% x $70,000 High-3 = $35,000/year for retirement pay. NOTE:

They are always treated as separate property. Even if the pension plan is ‘waived’ to receive the disability benefits, pursuant to the Supreme Court Case of Howell vs Howell, the service member does not have to ‘reimburse’ his/her former spouse for any loss due to the ‘waiver’ because that-in effect-would mean the disability payments are being divided. Therefore, disability waivers can often times cause a reduction in former spouse’s monthly payments-and the former spouse is just ‘out’ the money.
Good stuff now here is one for you the court gave half of my crsc to my ex well not ex yet I am 100 percent disabled vet the court keeps telling me i will go to jail if I dont hand her over my crsc at 1000 a month. I didnt know anything about appeal I have a TBI, so she gets it or I go to jail… So I am so happy that the law only applies to me and not the court or my ex, her attorney then put it in as alimony AND THE JUDGE SIGNED IT
to which the DoD will only send her 255 a month and now facing jail again for not paying the difference. SHE WAS DENIED ALIMONY.
Good so when the judge start docking money out the mans check for child support they can’t touch va compensation!
